Well, the put your minds at rest and to answer the guesses in my last post - yes, I had bought a new boat, and yes, it was a Warrior 175.

 

However... despote leaving a 10% deposit, it arrived back in this mornings post with a short letter explaining that circumstances had 'changed' and that the boat wasnt available any longer weep.gifmad.gif The guy did howver include a cheque to cover my costs.

 

That's 2 boats that have been pulled from under me in as many months! To be honest I'm pretty f$$ked off about the whole thing and cant really be bothered to look around anymore.

What has happened to honour amongst gentlemen?? I would have thought that a deposit secures against gazzumping.

 

Could you save up a bit longer.........and go for new??

 

That new one I saw Christmas time in Lymington.....with a gleaming new Honda 150 on the back..... looked just your ticket.

Private or brokerage? Private I guess.

Just by the by, a deposit only proves your good faith to the seller, not the sellers to you.

BUT if you PAY the seller for 'An Option To Purchase' although the price of said option is not returnable to you, it is a BINDING contract that gives ONLY YOU the right to purchase the item within the stated time limit of the option. If the owner will not go through with the deal or sells the item to someone else, or even dies he or his succesors are bound by your right to purchase within the stated period of the option. This is upholdable in law and also gives you rights of compensation if the agreed contract is not completed. However to be fair, if you don't complete in time you are not entitled for a refund of the price of the Option to Purchase

 

If needed I can draft out an Option to Purchase and email it through for future referance.

 

A verbal contract is not worth the paper it's written on as they say!!

Hi Adam , sorry to hear about what has happened. I'm probably like many others in thinking that putting a deposit down means that it's yours.

At present i am looking at 2 boats and trying to work out which one is the better deal.....After enquiring about one of the boats yesterday, I had a call from the salesman today to tell me that a chap from Devon had just turned up out of the blue and was crawling all over the boat i was interested in. He blatantly asked for my card details to secure a deposit from me, and this would stop him selling to the other guy. He said that as i was the first enquirer i was getting the first option. I said no way not until i had atleast seen the boat and worked out a deal and told him to get on and sell it if he gets a good offer,and i told him that the earliest i can get to see it was monday.

Does anybody know about how brokerages get away with stating that a boat that is built in '04 is advertised as an '05.? Is thera a chassis plate of some description?

Anyhow i agree that talk is cheap but luckily as you get older you do get wiser .

I'd be very interested in a copy of the option to purchase if available. PM me

I can only imagine how fed up you must feel, I am sure we understand why you were being so secretive and still the deal fel through.

Jasm first thing........ Brokerages like estate agents big get out is that they are only acting on information supplied by the current owner, and that they are only intermediaries.

 

Second...... If you bought and commissioned from brand new ANY craft and took delivery in January or Ferruary and possibly even March it is a given that the boat will have been made the year before. However to ascertain which 'Model Year' a craft is there must be significant 'Dating Features'. To crystalise the point any craft comissioned early in one year was probably built the year before but it only matters if there is a big differance in desige or style between one season and another.

Calmed down a little now.

 

Spoke to the guy yesterday. Basically he simply changed his mind rolleyes.gif . He was hugely apologetic, and as I mentioned popped a ton in the post for my hastle - still, I would rather have had the boat, oh well.

Bad luck mate, still may have been for the right reasons as she was very differetn from theother boats you had spied so far.

 

Good luck in the search, and as always, if I can offer any pearls of wisdom (not sure if that is possible) then just give me a call.
